We all closed 2010 with a wild finish, but what a way to start the new year. “2011, the Year of the Metal Rabbit, came crashing in with a Motion from Mr. Ed Du requesting the Court to allow him to amend and supplement the Petition that he had earlier filed against the NOMAD directors in the Regional Trial Court of Manila. The Motion seek the nullification of the amendments made to NOMAD’s Articles of Incorporation during the 15 May 2010 meeting and the purchase of the properties from E.A. Nersan Enterprises, as well as the inclusion of the Registrar of Deeds in the case. This just means one thing. - additional financial burden for everyone concerned. But don’t take my word for it. Read the notice, a copy of which is posted in the club’s bulletin board for your perusal. While we are at it, a Pre-Trial Brief was filed by Ed Du on January 14 stating that they will be presenting me as a hostile witness. Subject to the advice of our counsel, I will go eyeball to eyeball with Ed Du in a court of law. So, yes, bring it on. Also, in a related case wherein Nomad had intervened to protect its right to purchase the properties from E.A. Nersan Enterprises, Multi-Sphere Trading, Inc., recently filed a Motion seeking the nullity of a provision in the Compromise Agreement between Multi-Sphere, Nersan and Nomad, which granted Nomad the right to purchase the properties from Nomad. Recently I received a letter from a member who was outraged by this whole affair. She wrote: “This is a family sports club where the values of trust, camaraderie, and sportsmanship are developed among our children. It is our secure harbor when we experience storms and blackouts, literally and figuratively. A case against the club is a case against its members. Why is Ed Du doing this ?” We just left the first decade of the 21st century and onto our second. Our children, and eventually their own children will lead this club into its next 100 years.
Whether we like it nor not, there will come a time when maybe the young Dizons, Santiagos, Nelsons, De Joyas, Blakes, Whitwells, Thorps, Atkins’, Akillians, Polkinghornes, Lapenas, Goitias, Hannams, Williams, Taylors, among others. take over, remember, and talk about the tumultuous period during which the club was trying to buy the land where it stands now. When that time comes, how will we explain what we stood for? In the interest of fair play, Nomads News will allocate half a page for Ed Du and another half a page for Mr. Hemlani as the representative of Multisphere Trading Inc. to explain their side. Some members would like to hear from them. Our February issue goes to press on the February 14, so please send your signed letter to the club office on February 10. |
